The debate over the determination of death has been raging for more than fifty years. Since then, objections against the diagnosis of brain death from family members of those diagnosed as dead-have been increasing and are causing some countries to take novel steps to accommodate people’s beliefs and preferences in the determination of death. This, coupled with criticism by some academics of the brain death criterion, raises some questions about the issues surrounding the determination of death. In this paper, we (...) discuss some of the main approaches to death determination that have been theoretically proposed or currently put into practice and propose a new approach to death determination called "weak pluralism" as a reasonable ethical and political alternative to respect diversity in death determination. Requiring family authorization for apnea testing subtracts health professionals control over death determination, a procedure that has traditionally been considered a matter of clinical expertise alone. In this commentary, we first provide evidence showing that health professionals’ (HPs) disposition to act on death determination without family’s prior consent could be much lower than that referred to by Berkowitz and Garrett (2020). We hypothesize that HPs may have reservations about their own expertise as regards death, and may thus hesitate to impose (...) their views on patients’ families. We then address the theoretical question of clinical expertise in death determination by distinguishing judgments about facts (e.g., the presence or absence of spontaneous breathing) from interpretations given of these facts (i.e., their meaning for the vital status of an individual). We argue that, while clinicians may claim some expert authority on the former, they hold no particular authority on the latter. (shrink)

Background: This research explores how public awareness and attitudes toward donation and transplantation policies may contribute to Spain's success in cadaveric organ donation. Materials and Methods: A representative sample of 813 people residing in Andalusia (Southern Spain) were surveyed by telephone or via Internet between October and December 2018. Results: Most participants trust Spain's donation and transplantation system (93%) and wish to donate their organs after death (76%). Among donors, a majority have expressed their consent (59%), and few nondonors have (...) expressed their refusal (14%). Only a minority are aware of the presumed consent system in force (28%) and feel sufficiently informed regarding the requirements needed to be an organ donor (16%). Participants mainly consider that relatives should represent the deceased's preferences and be consulted when the deceased's wishes are unknown, as is the case in Spain. Conclusion: Public trust in the transplant system may contribute to Spain's high performance in organ donation. High levels of societal support toward organ donation and transplantation do not correspond with similar levels of public awareness of donation and transplantation policies in Spain. (shrink)

Este trabajo persigue reflexionar sobre el estatuto ontológico de la comunidad en base a la figura de Nietzsche como arcano de la apuesta teórica tiqquniana. Así, a partir de las consideraciones que Nietzsche realiza sobre la vida, junto con los diagnósticos que Tiqqun despliega a partir de su _metafísica crítica_, se explorarán algunos de los pliegues del pensamiento de ambos autores tratando de iluminar una cartografía de la no pertenencia que sustituya la lógica identitaria de la comunidad moderna fundamentada en (...) el principio de humanismo. Dicha cartografía no solo persigue agotar el lenguaje político contemporáneo, sino que piensa en una forma política y comunitaria desarrollada desde el _pathos_ de la distancia, el éxtasis y la filosofía política an-árquica. El esfuerzo teórico aquí recogido ilumina y teje la presencia de Nietzsche en el pensamiento de Tiqqun manifestando el anhelo compartido entre ambos autores por desatar prácticas de libertad en la tarea de traer al mundo las vidas que aún están por venir. En el presente artículo nos proponemos argumentar en favor de una concepción procesual de la identidad de la persona enferma. Para ello, recorreremos algunas de las principales respuestas que ha dado la filosofía a la pregunta por la identidad personal, así como ciertas propuestas sobre cómo concebir la enfermedad y la identidad de la persona enferma. A partir de la adopción de un enfoque procesual de la ontología, pondremos el foco en una interpretación procesual-relacional no dualista de los organismos biológicos.

Altruism and solidarity are concepts that are closely related to organ donation for transplantation. On the one hand, they are typically used for encouraging people to donate. On the other hand, they also underpin the regulations in force in each country to different extents. They are often used indistinctly and equivocally, despite the different ethical implications of each concept. This paper aims to clarify to what extent we can speak of altruism and solidarity in the predominant models of organ donation. (...) It also raises the ethical question of whether these categories are adequate as a basis for such models, bearing in mind that organs are a scarce resource and that a shortage of them may mean that fewer lives are saved or improved. El presente trabajo se ocupa del lugar de la religión en la última etapa de la obra de Habermas. En la primera parte se muestran las diferentes aristas de la cuestión de la religión, poniendo énfasis en los aspectos filosófico-políticos, sobre todo el que concierne a la “traducción” del lenguaje religioso al secular como un “requisito” de acceso a la esfera pública. En la segunda parte, se reconstruye, señalando sus límites o dificultades, el concepto de “traducción” en Habermas. In this work we argue that there is no strong demarcation between pure and applied mathematics. We show this first by stressing non-deductive components within pure mathematics, like axiomatization and theory-building in general. We also stress the “purer” components of applied mathematics, like the theory of the models that are concerned with practical purposes. We further show that some mathematical theories can be viewed through either a pure or applied lens. These different lenses are tied to different communities, which endorse (...) different evaluative standards for theories. We evaluate the distinction between pure and applied mathematics from a late Wittgensteinian perspective. We note that the classical exegesis of the later Wittgenstein’s philosophy of mathematics, due to Maddy, leads to a clear-cut but misguided demarcation. We then turn our attention to a more niche interpretation of Wittgenstein by Dawson, which captures aspects of the aforementioned distinction more accurately. Building on this newer, maverick interpretation of the later Wittgenstein’s philosophy of mathematics, and endorsing an extended notion of meaning as use which includes social, mundane uses, we elaborate a fuzzy, but more realistic, demarcation. This demarcation, relying on family resemblance, is based on how direct and intended technical applications are, the kind of evaluative standards featured, and the range of rhetorical purposes at stake. El presente trabajo se propone señalar algunas tareas posibles para la ética del discurso de Karl-Otto Apel en la actualidad. Tales tareas pueden concentrarse en la necesidad de una teoría de la institucionalización del discurso práctico, como forma de racionalidad práctica realizada socialmente. La pregunta que se ha de responder es qué condiciones marco debe cumplir el discurso para que pueda ser puesto en práctica y qué efectos político-institucionales puede producir en el contexto de instituciones realmente existentes. A partir de (...) Gehlen y de Luhmann -aunque en menor medida-, Apel interpreta a las instituciones como sistemas de autoafirmación que, por un lado, liberan a los sujetos de la carga de la acción, pero, por otro lado, limitan o condicionan la racionalidad práctica consensual-argumentativa propia del discurso. Las coerciones (Sachzwänge) funcionales de las instituciones configuran un campo de acción y un tipo de racionalidad que, de acuerdo con Apel, deberían estar bajo el control del discurso institucionalizado como esfera pública racional (Öffentlichkeit). La relación entre los criterios normativos ideales del discurso práctico institucionalizado y las instituciones realmente existentes debe interpretarse como una tensión o entrelazamiento dialéctico no superable. Si esta interpretación es correcta, la ética del discurso, en tanto teoría crítica de la sociedad, no puede ser entendida como una aplicación sin más de criterios normativos ideales a la realidad histórica o de adecuación de esa realidad a los criterios ideales en su sentido vertical, sino como de mutua correlación horizontal. En este artículo exploramos los elementos y temas rurales y campesinos en la poética y el pensamiento de Antonio Machado. Su «palabra esencial en el tiempo» tendría un carácter eminentemente rural fruto de su aguda conciencia de la modernización capitalista como una fuerza abstracta que socava las formas de producción y socialización campesina y que impone una lógica productiva que imposibilita una relación de no explotación con la naturaleza y la conformación de una sociedad emancipada. Relacionamos esta consideración de la (...) temporalidad capitalista con la que contemporáneamente establecieron Walter Benjamin y Ernst Bloch. En la exploración del pasado y de formas de experimentar el tiempo premodernas estos pensadores descubrirían un potencial emancipatorio que debiera ser explotado por cualquier proyecto revolucionario. Este trabajo realiza un estudio metafísico sobre la noción de contacto en términos de límites a partir de una ontología de objetos materiales. Dos cosas están en contacto cuando sus límites (o partes de ellos) se topan espacialmente. Las tesis relacionista y la substantivista sobre la naturaleza del espacio son evaluadas en sus compromisos respecto a la idea de contacto. Sin embargo, puesto que considerando algunos descubrimientos de la física cuántica es posible descartar la idea de contacto físico, la discusión (...) requiere ser trasladada a un espacio topológicamente continuo. Aquí la idea de contacto requiere solucionar la compatibilidad entre la existencia de un espacio continuo y la existencia de límites como un tipo de discontinuidad. Cuatro tesis son evaluadas: clásica, superposición, brecha, y coincidencia. Esta última es defendida puesto que, a diferencia de las otras, no renuncia a características ontológicas fundamentales de un límite y es la menos arbitraria sobre su pertenencia. (shrink)

Gonzalo Rodriguez-Pereyra presents an original study of the place and role of the Identity of Indiscernibles in Leibniz's philosophy. The Principle of the Identity of Indiscernibles rules out numerically distinct but perfectly similar things; Leibniz derived it from more basic principles and used it to establish important philosophical theses. Rodriguez-Pereyra aims to establish what Leibniz meant by the Principle of Identity of Indiscernibles, what his arguments for and from it were, and to assess those arguments and Leibniz's claims about (...) the Principle of Identity of Indiscernibles. He argues that Leibniz had a very strong version of the principle, according to which no possibilia are intrinsically perfectly similar, where this excludes things that differ in magnitude alone. The book discusses Leibniz's arguments for the Identity of Indiscernibles in the Meditation on the Principle of the Individual, the Discourse on Metaphysics, Notationes Generales, Primary Truths, the letter to Casati of 1689, the correspondence with Clarke, as well as the use of the Identity of Indiscernibles in Leibniz's arguments against the Cartesian conception of the material world, atoms, absolute space and time, the Lockean conception of the mind as a tabula rasa, and freedom of indifference. Rodriguez-Pereyra argues that the Identity of Indiscernibles was a central but inessential principle of Leibniz's philosophy. (shrink)

Grau and Pury (Review of Philosophy and Psychology, 5, 155–168, 2014) reported that people’s views about love are related to their views about reference. This surprising effect was however not replicated in Cova et al.’s (in press) replication study. In this article, we show that the replication failure is probably due to the replication’s low power and that a metaanalytic reanalysis of the result in Cova et al. suggests that the effect reported in Grau and Pury is real. (...) We then report a large, highly powered replication that successfully replicates Grau and Pury 2014. This successful replication is a case study in the challenges involved in replicating scientific work, and our article contributes to the discussion of these challenges. (shrink)

In this study, we propose considering membership in the Ethics Officer Association (EOA) as a proxy for the firm's commitment to ethical decision making, and we analyze the influence of firm- and CEO-specific characteristics on this commitment. While we observe a positive relationship between membership and firm size, we also document a negative relationship between EOA membership and the executive's time in position and, to a more modest extent, accounting returns. Pursuing this further, we present evidence that firms with past (...) legal issues may seek EOA membership as a signal of their intention to be compliant in the future. (shrink)

Todo el curso gravita sobre la función reproductiva de la trompa. La trompa, en fin de cuentas, es un oviducto. Ya bastante habrán dicho de todo ello Michel Idoate y Fernando de la Fuente. Yo lo que quiero hacer en mi charla es llamar la atención sobre los aspectos éticos de unos pocos hechos básicos: que, de ordinario, la fecundación tiene lugar en la ampolla tubárica y que aquí y en el istmo transcurren las primeras horas y los primeros días (...) del desarrollo embrionario. Estos hechos, tan conocidos, tienen implicaciones ético-médicas muy importantes. La principal de ellas, se refiere a quien sea el embrión humano que se engendra en la trompa y en ella habita cuatro o cinco días. Pero, no menos importante, es la que se refiere a cuáles son las relaciones éticas que han de establecerse entre el médico y la mujer en cuya trompa flota un embrión. (shrink)

Este artículo se ocupa del impacto que el uso de los sistemas predictivos automatizables tiene, y puede tener en un futuro inmediato, en la actividad decisional. Para abordar esta cuestión se han elegido tres aspectos que se consideran centrales: la inclusión de elementos evaluativos en los sistemas predictivos, el estatus normativo de los sistemas predictivos utilizados, y, en tercer lugar, la responsabilidad por la configuración formal y sustantiva del proceso decisional.

The hypothesis that this paper seeks to propose is that, despite all the difficulties for its conceptualization, Bataille postulates that the community is, after all, possible. To do this, we will seek to study the place of the community in Bataille's thought, a place that is not precisely identifiable at all, but rather is scattered throughout his work at different points. Thus, we will try, in the first instance, to analyze how a lost community appears in the French philosopher, in (...) order to, in a second place, investigate what was the - misguided - fascist response to that fact, and, finally, outline how it could erect a proactive model of community according to Bataille. According to an influential view, when it comes to representing reality, some words are better suited for the job than others. This is elitism. There is reason to believe that the set of the best, or elite, words should not be redundant or arbitrary. However, we are often forced to choose between these two theoretical vices, especially in cases involving theories that seem to be mere notational variants. This is the riddle of redundancy: both redundancy and arbitrariness are vicious, but (...) there are cases in which one must be picked. Logical realists admit that there are some logical constants among the elite words. This leads to awkward questions, such as which among conjunction and disjunction is elite. In this paper, I show how the riddle of redundancy arises for logical realists, and offer a solution. This approach requires us to change how we represent negation. Instead of using some particular symbol, we represent negation by flipping formulae over the horizontal axis. (shrink)

Figurative communication (the use of metaphor, metonymy, hyperbole and irony) provides economy of expression, clarity, persuasiveness, politeness, evaluation, and communication of emotions. However, it also increases the potential for misunderstanding in situations when people lack shared background knowledge. This book combines theoretical frameworks with empirical studies that measure the effectiveness of different approaches to the use of figurative language in advertisements, to show how to maximise the benefits of creative metaphor and metonymy in global advertising. It highlights how subtle differences (...) in colour, layout, and combinations of different kinds of figurative language affect the reception and appreciation of creative advertising, shedding new light on the nature of figurative communication itself. With a balance between theory, experiments and practical case studies, this book is accessible for academics in linguistics and communication studies, as well as advertising and marketing professionals. En el presente trabajo se pretende llevar a cabo una aproximación al fenómeno del colapso ecológico y su relación con la filosofía de la historia a través de las aportaciones de Walter Benjamin y Theodor Adorno. En este sentido, el fenómeno del colapso ecológico será abordado como la barbarie de nuestro tiempo, introduciéndonos en uno de los conceptos con mayor recorrido en la teoría crítica, para acto seguido explorar diversas vías filosóficas abiertas para hacerle frente en la actualidad.

El presente artículo tiene como objetivo principal presentar los principales resul- tados de una experiencia de innovación docente implementada en el 4º curso del Programa de Doble Grado en Derecho y Ciencias Políticas y de la Administración de la Universitat de València (UV). En concreto, se propuso, por parte del docente, una serie de fichas en las que se diseñaran medidas para acabar con la corrupción. Esta actividad tuvo lugar durante los meses de abril y mayo de 2022. The influence of age and formal education on the development of moral reasoning in a Spanish sample of students was assessed by using a Spanish translation of Rest's Defining Issues Test. Our results support the hypothesis that moral development is highly related to both variables in our cultural context, although more so with formal education than with age.

This paper addresses some relations between the spatial politics of queer assemblies in spaces of protest and the constitution of collective political subjects. It does so by exploring the spatial politics of queer activism within the global Occupy movements, in the light of Judith Butler’s work on the performative power of assembly and the ambivalences of the Foucauldian concept of heterotopia. Specific challenges faced by queer activists in various encampments will be addressed in order to expose some tensions between the (...) constitutive exclusions inherent to the constitution of spaces of protest and the processes of coalition building needed to effectively overcome those very constitutive exclusions.
